Privacy Policy

Overview

VitalBrief is a wellness app that reads Apple Health data on your device and generates AI-powered reports. Your privacy is not a feature, it's the foundation of how the app is built.

Data We Collect

We do not collect personal information. VitalBrief has no user accounts, no login, no email collection, and no registration of any kind. We do not receive your name, email, or Apple ID.

Health Data

VitalBrief accesses the following health data types from Apple HealthKit, with your explicit permission. The app works with any device that syncs to Apple Health, including Apple Watch, Garmin, Oura Ring, Whoop, Fitbit, and Withings:

  • Activity: Steps, distance walked/run, active energy burned, exercise minutes, stand hours
  • Heart: Resting heart rate, heart rate variability (HRV), heart rate recovery
  • Body: Body mass, respiratory rate, blood oxygen saturation (SpO2), walking steadiness, wrist temperature
  • Sleep: Sleep duration and sleep stage analysis
  • Fitness: VO2 Max, workout sessions (type, duration, distance, heart rate zones, cadence)
  • Other: Daylight exposure time

This data is used exclusively to generate your wellness reports. It is never used for advertising, data mining, or any purpose other than the app's core functionality.

How Your Data Is Stored

All data, including your profile, preferences, and generated reports, is stored locally on your device. VitalBrief does not maintain any server-side database or cloud backup of your data. Your health information lives on your device, protected by Apple's built-in security.

AI Report Generation

When you generate a report, anonymized health metrics are processed by an external AI service to create your wellness insights. Here's what you should know:

  • The data contains no personally identifiable information, no name, no email, no device ID, no account ID
  • Only the health metrics needed for the report are included (e.g., step counts, heart rate averages, workout summaries)
  • Basic profile context is included (age range, height, biological sex, sport preferences) to personalize insights. If you've added optional notes in the "About You" field, that text is also included. No other personal information is sent.
  • Data is transmitted over encrypted connections (HTTPS/TLS)
  • AI providers operate under agreements that prohibit using your data for training

You provide explicit consent before any health data is processed by the AI service for the first time.

Notifications

VitalBrief uses local notifications only. These are scheduled on your device to let you know when a new report is available. No remote push notification server is involved. No notification data leaves your device.

Subscriptions

Subscriptions are managed entirely through Apple's App Store and StoreKit framework. We do not process, store, or have access to any payment information. All billing is handled by Apple.

Third-Party Services

When generating reports, your data is processed by two external services: a secure proxy (Cloudflare) that routes your request, and an AI service that generates your report. Neither service receives your name, email, or any personal identifier. We do not use analytics SDKs, advertising networks, crash reporting tools, or any other third-party services that collect user data.

Children's Privacy

VitalBrief is not designed for or directed at children under 13. We do not knowingly collect information from children.

Data Deletion

Since all data is stored on your device, you have complete control. You can delete all app data at any time by deleting the app from your device. VitalBrief does not maintain any server-side copy of your data.

Changes to This Policy

If we update this privacy policy, we will post the revised version at this URL with an updated date. Significant changes will be communicated through the app.

Terms of Use

1. Agreement

These Terms of Use ("Terms") are a binding agreement between you and VitalBrief ("we," "us," the "Developer") regarding your use of the VitalBrief mobile application (the "App"). By installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Apple Inc. ("Apple") is not a party to these Terms. Section 14 sets out Apple-specific provisions.

2. Not Medical Advice

VitalBrief is a wellness app, not a medical device. It does not diagnose, treat, cure, prevent, or monitor any disease or health condition. Trends, patterns, insights, and observations generated by the App are for informational and educational purposes only, are not medical advice, and should not be relied on as a substitute for consultation with a qualified healthcare professional.

Always consult a qualified healthcare professional before making decisions about exercise intensity, training load, medication, symptoms, or any other health matter. If you are experiencing a medical emergency, contact your local emergency services immediately.

3. Eligibility

You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction, whichever is higher, to use the App. By using the App you represent and warrant that you meet this requirement.

4. Subscription, Billing, and Cancellation

The App is offered on a subscription basis (monthly and annual) through the Apple App Store.

  • Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions auto-renew at the end of each period unless cancelled at least 24 hours before the end of the current period.
  • You manage and cancel your subscription in your Apple ID account settings.
  • Refunds, where available, are handled by Apple under the Apple Media Services Terms and Conditions. The Developer does not process refunds directly.
  • Pricing may change. You will be notified before any price change takes effect in accordance with Apple's policies.
  • Cancellation stops future billing. Reports and data already on your device remain accessible until you delete the App.

5. Health Data and Privacy

The App reads health and activity data from Apple Health only with your explicit authorization. You may revoke this permission at any time in iOS Settings → Privacy & Security → Health.

How we handle your data, including what we process, what we transmit, and what we store, is described in our Privacy Policy, which is incorporated into these Terms by reference.

6. Your Content

"About You" notes, workout notes, weekly/monthly context notes, and any other text you enter remain yours. By using the App, you grant us a limited, non-exclusive, royalty-free license to process that text solely to deliver the App's features, primarily to include it in the AI prompt that generates your reports. We do not sell your content. We do not use it to train AI models.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation;
  • Reverse-engineer, decompile, disassemble, or attempt to extract the App's source code, except to the extent expressly permitted by law;
  • Submit health or personal data belonging to another person without their explicit consent;
  • Attempt to bypass subscription, authentication, or other access controls;
  • Use the App in a manner that could damage, disable, overburden, or impair its functioning;
  • Use the App to make clinical, diagnostic, or emergency-care decisions.

8. Intellectual Property

The App, including its name, logo, visual design, source code, prompt templates, and written content (other than your own inputs), is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-transferable, non-sublicensable license to use the App on Apple-branded devices you own or control, subject to these Terms and to the Apple Media Services Terms.

9. Third-Party Services

The App transmits anonymous health metrics to an AI service via a Cloudflare-hosted proxy. Your use of those services is also subject to their respective terms. We configure AI providers for zero data retention where supported, but we do not control their policies. We are not responsible for the acts or omissions of third-party service providers.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

Without limiting the foregoing, we do not warrant that:

  • The App will be uninterrupted, secure, or error-free;
  • Insights, patterns, trends, or observations produced by the App are accurate, complete, timely, or applicable to your individual circumstances;
  • HealthKit data received by the App is accurate; the App displays what Apple Health provides.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE DEVELOPER'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VITALBRIEF IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations above apply to the maximum extent permitted by law. Nothing in these Terms limits rights you may have under mandatory consumer protection laws in your country of residence.

12. Termination

You may stop using the App at any time and delete it from your device. We may suspend or terminate your access to the App if you materially breach these Terms.

Sections that by their nature should survive termination, including Sections 6 (license to process content), 8 (IP), 10 (Disclaimers), 11 (Limitation of Liability), 14 (Apple-Specific Terms), 15 (Governing Law), and 16 (Contact), will survive.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or on the website. The "Last updated" date at the top of these Terms reflects the most recent revision. Your continued use of the App after changes take effect means you accept the updated Terms.

14. Apple-Specific Terms

The following provisions apply specifically because the App is distributed through the Apple App Store. They implement Apple's minimum-terms requirements for custom end-user license agreements.

  • Acknowledgment. These Terms are concluded between you and the Developer only, and not with Apple. The Developer, not Apple, is solely responsible for the App and its content.
  • Scope of License. Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
  • Maintenance and Support. The Developer is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance or support services in connection with the App.
  • Warranty. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.
  • Product Claims. The Developer, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the HealthKit framework.
  • Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer Contact Information. For questions, complaints, or claims regarding the App, contact the Developer at the address in Section 16.
  • Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App.
  • Third-Party Beneficiary. You and the Developer acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Brazil (State of São Paulo), excluding conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising from or related to these Terms or the App will be resolved in the competent courts of Brazil, except where the applicable consumer protection law grants you the mandatory right to bring proceedings in the jurisdiction of your residence.
